DMCA Policy
DMCA Policy
Lux Designer is committed to respecting the intellectual property rights of others. We comply with the Digital Millennium Copyright Act (“DMCA”) and promptly address valid notices of alleged copyright infringement. Our platform provides articles on various design topics, and we expect all users to respect copyright law.
This policy outlines the procedures for copyright owners to report alleged infringements and for users to submit counter-notifications. We take claims seriously to ensure a fair and lawful environment for our content creators and readers.
Reporting Copyright Infringement (DMCA Takedown Notice)
If you believe that content hosted on lux-designer.com infringes your copyright, please send a written DMCA Takedown Notice to our designated agent. Your notice must include specific information to be valid under the DMCA. Submitting a false claim may lead to liability for damages.
Ensure your notice contains all required elements before submission. This helps us process your request efficiently and accurately.
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works.
- Identification of the material claimed to be infringing or to be the subject of infringing activity and that is to be removed or access disabled, and information reasonably sufficient to permit Lux Designer to locate the material (e.g., specific URLs).
- Information reasonably sufficient to permit Lux Designer to contact the complaining party, such as an address, telephone number, and email address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Counter-Notification Process
If you believe your content was removed or access disabled due to a mistake or misidentification, you may submit a counter-notification. This allows you to dispute the copyright infringement claim. Please note that filing a false counter-notification can result in legal consequences.
Your counter-notice must also include specific details. We will forward your counter-notification to the original complaining party. They may then choose to file a lawsuit to keep the content from being restored.
- Your physical or electronic signature.
- Identification of the material that was removed or to which access was disabled, and the location where the material appeared before its removal or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district where your address is located, or if your address is outside of the United States, for any judicial district in which Lux Designer may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
